This Indenture Made this 28th day of December in the year of Our Lord One Thousand Eight Hundred and Eighty seven between W.S. Lockard and Caroline M. Lockard his wife of the county of Jackson and State of Missouri of the rst part and Elizabeth Mosty of the county of Jackson and State of Missouri of the second part.
Witnesseth, That said party of the rst part for and in consideration of the sum of Nine Thousand four hundred (9400) Dollars to them duly paid, the receipt whereof is hereby acknowledged have sold and by these presents do – grant bargain sell and convey to the said party of the second part her heirs and assigns, all the following described tract – pieces and parcel – of land, situated in the County of Bourbon and State of Kansas to wit.
All of the East half (E. 1/2) of section fourteen (14) in Township twenty seven (27) south in Range twenty two (22) East, containing 320 acres to the same more or less.
As a part of the consideration for the conveyance the said Elizabeth Mosty hereby assumes and agrees to pay off and discharge in full both principal and interest when due two certain promissory notes both dated May 14, 1886 and signed by the said W.S. Lockard in form of the Lombard Investment Co. one of same being for the principal sum of Four Thousand Dollars ($4000) due June 1, 1891, and bearing interest at the rate of six per cent per annum from date until paid payable semi annually and the other for the sum of Five Hundred Dollars ($500) due Dec 1, 1888 with interest after maturity at twelve per cent per annum which said notes are secured by separate mortgages of the above described real estate.
The deed is given subject to a lease to I.N. Johnson expiring March 1, 1889 the said Lockard to have the rent up to March 1, 1888, and the said Mosty from that time forward.
With the appurtenances and all the estate title and interest of the said part of the rst part therein. And the said W.S. Lockard does hereby covenant and agree that at the delivery hereof he is the lawful owner of the promises above granted, and seized of a good and indefeasible estate of inheritance therein le and clear of all incumbrances. Excepting the above mentioned mortgages and all taxes for the year 1888 and thereafter and that he will warrant and defend the same in the quiet and peaceable possession of said party of
